1. Acceptance of Terms

By accessing or using FitnessData Platform ("the Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

FitnessData provides personal trainers with tools for client management, workout planning, progress tracking, digital contracts, and payment tracking. The Service is provided on a subscription basis after a free trial period.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information when creating an account and to update such information as necessary.

4. Subscription and Payments

Subscriptions are billed in advance on a monthly or annual basis through our merchant of record, Polar. You may cancel at any time from the app or the billing portal. EU/UK consumers have a 14-day right of withdrawal with a full refund, as described at checkout; apart from this, no refunds are provided for partial billing periods.

5. Data and Privacy

We process personal data in accordance with our Privacy Policy. You are responsible for obtaining valid consent from your clients before storing their health data on the platform. Read the Privacy Policy.

6. Acceptable Use

You agree not to use the Service for any unlawful purpose, not to attempt to breach security measures, and not to resell the Service without written authorization.

7. Intellectual Property

All content, trademarks, and software associated with the Service are the property of FitnessData Platform or its licensors. You may not copy, modify, or distribute them without permission.

8. Limitation of Liability

To the fullest extent permitted by law, FitnessData Platform shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
